1. Acceptance of Terms

By downloading, installing, or using GetFerti, you confirm that you have read, understood, and agreed to these Terms, as well as our Privacy Policy. These Terms form a legally binding agreement between you and FertiHealth Inc. We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

GetFerti is intended for individuals aged 18 and above. By using the App, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the App under applicable law

If you do not meet these criteria, you are not permitted to use GetFerti. We reserve the right to suspend or terminate accounts that do not meet eligibility requirements.

3. About GetFerti

GetFerti is an AI-powered fertility education platform. It delivers evidence-based information grounded in peer-reviewed medical literature and clinical expertise, presented through a conversational mobile interface.

GetFerti is designed to help users learn, explore, and better understand fertility-related topics. It is an educational tool — not a clinical service. Use of the App does not constitute enrollment in any medical program or establishment of a care relationship of any kind.

4. Medical Disclaimer

GetFerti is not a medical service. Nothing in the App — including AI-generated responses, articles, summaries, or any other content — constitutes medical advice, diagnosis, treatment, or prescription.

Specifically, the App does not:

• Diagnose any medical condition
• Recommend or prescribe medications or treatments
• Create a doctor–patient or therapist–patient relationship
• Replace consultation with a licensed healthcare provider

Always seek the advice of a qualified physician, reproductive endocrinologist, or other licensed healthcare professional regarding any medical questions or conditions. Never disregard professional medical advice or delay seeking it based on information you have received through GetFerti.

5. Emergency Notice

GetFerti is not equipped to handle medical emergencies. If you believe you are experiencing a medical emergency — including but not limited to severe pain, heavy bleeding, signs of ectopic pregnancy, or any other urgent health concern — call emergency services (911 or your local equivalent) immediately.

Do not use GetFerti in place of emergency care. The App is not monitored in real time and cannot dispatch emergency assistance.

6. AI Transparency

GetFerti uses artificial intelligence to generate informational responses. You should be aware of the following:

• AI-generated content is not infallible. Responses are based on patterns in medical literature and may not reflect the most current clinical guidelines or research.
• Responses are not personalized medical advice. The App does not have access to your full medical history and cannot account for individual circumstances the way a physician can.
• The AI may make errors. While we work hard to ensure accuracy, AI systems can produce incorrect or incomplete information. Always verify important health information with a qualified professional.
• We continually improve our systems. We update our AI models and knowledge sources regularly, but there may be gaps or delays in reflecting the latest medical developments.

7. User Accounts

To access GetFerti, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your login credentials confidential and not share them with anyone
• Notify us immediately at hello@getferti.com if you suspect unauthorized access to your account
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate your account if we have reason to believe your credentials have been compromised or your account is being misused.

8. User Responsibilities

By using GetFerti, you agree to use the App lawfully and respectfully. You agree not to:

• Use the App for any purpose that is illegal, harmful, or fraudulent
• Submit false, misleading, or third-party health data without proper authorization
• Attempt to reverse engineer, scrape, or extract data from the App
• Circumvent or interfere with the App's security features or infrastructure
• Use the App to harass, harm, or exploit others
• Reproduce, redistribute, or commercially exploit any content from the App without written permission

Violation of these responsibilities may result in immediate account suspension and, where applicable, legal action.

9. HIPAA-Level Data Protection

FertiHealth Inc. applies HIPAA-level safeguards to protect health-related data processed through GetFerti. These safeguards include:

• Encryption of data in transit (TLS) and at rest (AES-256)
• Strict role-based access controls limiting internal data exposure
• Secure, enterprise-grade cloud infrastructure
• Regular security assessments and monitoring

While we apply these high standards, use of GetFerti does not make FertiHealth Inc. your HIPAA-covered entity or business associate in a formal healthcare relationship. For full details on how your data is handled, please review our Privacy Policy.

10. Intellectual Property

All content within GetFerti — including but not limited to text, graphics, logos, AI models, algorithms, software, and user interface design — is the exclusive intellectual property of FertiHealth Inc. or its licensors, and is protected by copyright, trademark, and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not:

• Copy, modify, or distribute any content from the App
• Use GetFerti's branding or name in any way that implies endorsement
• Sublicense, sell, or transfer your right to use the App

Any unauthorized use of our intellectual property is a violation of these Terms and may be subject to legal remedies.

11. Third-Party Services

GetFerti may integrate with or link to third-party services, platforms, or resources. These third parties have their own terms and privacy policies, which we encourage you to review. FertiHealth Inc. is not responsible for the content, practices, or availability of any third-party service, and your use of such services is at your own risk.

12. Disclaimers

The App is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. To the fullest extent permitted by law, FertiHealth Inc. disclaims all warranties, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, completeness, or timeliness of any content

Your use of GetFerti is at your sole discretion and risk.

13. Limitation of Liability

To the maximum extent permitted by applicable law, FertiHealth Inc. and its officers, directors, employees, and affiliates shall not be liable for:

• Any medical outcomes, health decisions, or clinical results arising from use of the App
• Any indirect, incidental, consequential, punitive, or special damages
• Loss of data, revenue, or goodwill
• Any damages resulting from unauthorized access to your account or data

This limitation applies regardless of the legal theory under which liability is claimed, even if FertiHealth Inc. has been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless FertiHealth Inc. and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:

• Your use of or inability to use the App
• Your violation of these Terms
• Your submission of false or unauthorized data
• Any third-party claims resulting from your actions through the App

15. Termination

We reserve the right to suspend or terminate your access to GetFerti at any time, with or without notice, for any reason — including violation of these Terms. You may also delete your account at any time by contacting us at hello@getferti.com. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Washington, USA, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Seattle, Washington, in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.

17. Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will notify you via the App or by email. The updated Terms will include a revised effective date. Your continued use of GetFerti following any update constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the App.
